Today the California Supreme Court issued a surprising and unfortunate decision in Augustus v. ABM Security Services, Inc., holding that employers cannot require employees to remain “on-call” during rest breaks, even though these short breaks are part of the employees’ paid hours worked. The Court held that the same standard that applies to off-duty meal breaks applies to paid rest break time. More specifically, California law requires that during unpaid, off-duty meal breaks, employees must be relieved of all duties and free from employer control as to how they spend their time. The Court today held that this is also true for paid rest break time and that an employer does not comply with this standard if it requires employees to remain “on-call,” i.e. viligant and available for possible interruption during rest breaks. This ruling results in the potential reinstatement of a $90 million verdict against the security company, whose security guards remained on-call during rest breaks and carried radios or other communication devices in the event they needed to return to work. Even though the record showed that breaks were rarely interrupted and that this on-call requirement was tied to the nature of the work as a security guard, the Court held that the on-call requirement invalidated the rest breaks. “Because rest periods are 10 minutes in length (Wage Order 4, subd. 12(A), they impose practical limitations on an employee‘s movement. That is, during a rest period an employee generally can travel at most five minutes from a work post before returning to make it back on time. Thus, one would expect that employees will ordinarily have to remain onsite or nearby. This constraint, which is of course common to all rest periods, is not sufficient to establish employer control. But now add to this state of affairs the additional constraints imposed by on-call arrangements. Whatever else being on call entails in the context of a required rest break, that status compels employees to remain at the ready and capable of being summoned to action (see, e.g., Mendiola, supra, 60 Cal.4th at p. 837). Employees forced to remain on call during a 10-minute rest period must fulfill certain duties: carrying a device or otherwise making arrangements so the employer can reach the employee during a break, responding when the employer seeks contact with the employee, and performing other work if the employer so requests. These obligations are irreconcilable with employees‘ retention of freedom to use rest periods for their own purposes. (Morillion v. Royal Packing Co. (2000) 22 Cal.4th 575, 586.)
This very case provides an apt example. The trial court determined it was undisputed that ABM‘s policy required plaintiffs to keep radios and pagers on, remain vigilant, and respond if the need arose. Given these intersecting realities, on-call rest periods do not satisfy an employer‘s obligation to relieve employees of all work-related duties and employer control. In the context of a 10-minute break that employers must provide during the work period, a broad and intrusive degree 17 of control exists when an employer requires employees to remain on call and respond during breaks. (See Wage Order 4, subd. 12(A) [employers must provide a 10-minute rest period per every four hours worked and the break should, whenever practicable, fall in the middle of the work period].) An employee on call cannot take a brief walk — five minutes out, five minutes back — if at the farthest extent of the walk he or she is not in a position to respond. Employees similarly cannot use their 10 minutes to take care of other personal matters that require truly uninterrupted time — like pumping breast milk (see § 1030 [regarding use of break time for expressing milk for an infant]) or completing a phone call to arrange child care. The conclusion that on-call rest periods are impermissible is not only the most logical in light of our construction of Wage Order 4, subdivision 12(A), but is the most consistent with the protective purpose of the Labor Code and wage orders. (Murphy, supra, 40 Cal.4th at p. 1105 [―rest periods have long been viewed as part of the remedial worker protection framework‖].) A different result would undermine the rationale underlying the provision of rest periods during the workday. (Id. at p. 1113; Morillion v. Royal Packing Co., supra, 22 Cal.4th at p. 586.)”
In this author’s opinion, the Court’s decision is unreasonable and impractical, and serves only to further the onslaught of shakedown lawsuits against California employers for alleged violations of meal and rest break laws. A rest break is 10 minutes worth of time and it is paid. Because rest break time is so limited, employees necessarily remain on the employer’s premises and subject to the employer’s control by virtue of remaining subject to the employer’s workplace conduct policies. Simply being required to be available via cell phone (or some similar method of contact) during a rest break in case a work need arises does not mean that the employee cannot use the rest break time to “rest” or conduct personal business. It just means that the rest break time might get interrupted on occasion. Under the Court’s reasoning, the rest breaks are not valid rest breaks even if they are not, in fact, interrupted. The mere requirement to remain available for interruption invalidates the rest break – even though the employee is being PAID by the employer for this time. With all due respect Court, this is going too far -- even in California. Furthermore, the decision is contrary to precedent. California Labor Code section 226.7 simply says that employees cannot be required “to work” during rest breaks. It does not say that employees must be relieved of all duty and free from employer control. Moreover, even if this was the standard, the California Supreme Court in Brinker v. Superior Court previously acknowledged that what may suffice to provide compliant breaks may vary from industry to industry and that an employer’s basic requirement is to provide employees a “reasonable opportunity” to take breaks. Being required to remain on-call is not the same thing as being required to work (particularly on a factual record showing that that even though employees are on-call during rest breaks, their rest breaks are in fact rarely interrupted) and does not deprive employees of a reasonable opportunity to rest – particularly in the context of the security industry where guards commonly have idle time throughout the day. The Court of Appeal agreed with this reasoning, but the California Supreme Court rejected it. Justices Kruger and Corrigan thoughtfully dissented.
My opinions aside, the Court’s decision is of course now the law in California. That means employers cannot have policies requiring employees to remain on-call (or to otherwise perform any work) during paid rest breaks. Policies exerting other types of “control” over employees’ activities during rest breaks may also come under fire under this new decision. One exception is requiring employees to remain on the premises – the Court appears to have acknowledged that this is still okay.
Now, let’s be clear about what the decision does not mean. It does not mean that a rest break can never be interrupted or denied. This can still happen. You just can’t require your employees to remain “on-call” and available for interruption. Of course, if you interrupt an otherwise valid rest break before the employee has completed the full 10 minutes or you tell an employee he or she cannot take a rest break due to work demands, you have to pay the employee one hour of pay for the missed break or, in the case of an interrupted break, allow the employee to re-start their rest break once the interruption is completed.

At home, Saumya proposes a paragliding trip, hoping Dhruv will recreate his initial proposal. Maaji, meanwhile, works to gather evidence against Dhruv, who dismisses her warnings to mend his ways. During a Holi celebration, Shailee and Dhruv share a moment, prompting Saumya to lead Dhruv on a paragliding outing. Mid-flight, Dhruv's harness fails, but both narrowly escape. The film was officially announced on 5 July 2023 as a Netflix thriller, titled Do Patti and led by Kajol and Kriti Sanon, in their second film post Dilwale (2015).[6] It also marks Kanika Dhillon's production debut under Kathha Pictures, with Kriti Sanon turning producer as well, under her banner Blue Butterfly Films.[7] In October 2023, television actor Shaheer Sheikh joined the cast.[8]
Principal photography commenced in August 2023.[9] Filming took place in Mumbai, Nainital, and Dehradun.[10][11] The filming wrapped up in December 2023.[12]
The first single titled "Raanjhan" was released on 4 October 2024.[13] The second single titled "Akhiyaan De Kol" was released on 18 October 2024.[14]
The song "Akhiyaan De Kol" was a remake of the song "Ankhiyan Nu Rehan De" by the Pakistani singer Reshma.[15]
Do Patti received mixed reviews from critics.[16][17][18] On the review aggregator website Rotten Tomatoes, 50% of 10 critics' reviews are positive, with an average rating of 5.2/10.[19] It received mixed reviews from audiences.[20][21]
Sukanya Verma of Rediff.com rated the film 2 out of 5, writing, "Dysfunctionality triggered by scarred childhood is a valid point but doesn't find an active voice in Do Patti's half-baked diabolism, which needed to be more Dead Ringers than The Parent Trap.[22] Shubhra Gupta of The Indian Express gave the film 1.5 out of 5, writing, "There’s enough in Kriti Sanon-Kajol film for a juicy, substantive drama. But the unpacking turns more into an unravelling, mainly because the writing is shallow, and the characters lack depth."[23]
Aakriti Agarwala of The Statesman writes, "Do Patti aimed to connect several social issues of generational trauma, domestic violence, and discourse around patriarchy and its inherent nature via a thriller. Additionally, the film hinged upon the dichotomy between the ‘word of law’ and the ‘spirit of law’ but it lacked the punch to do so. Despite harbouring good intentions, the unidimensional characterisations and a convenient storyline don’t leave much scope to weigh on the issues."[24]
It trended on the Netflix Global Top Ten Charts (Non-English) Film in over 30 countries, and stayed on the trending charts for over 50 days. [25] It also broke records by being the only Indian film across all platforms to be on the prestigious Variety's Top Ten list of Most Watched Streaming Originals, on position 9, garnering a whopping 92.4 Million views. The son of Italian immigrants Maria Antoinette (Occhipinti) and Frank Rizzo Di Cavalcante, Simone Paul Rizzo DeCavalcante was born in the Brooklyn borough of New York City and raised in Trenton, New Jersey.[1] His birth date has been reported as April 30, 1913. Claiming descent from an Italian marquis, Michelangelo Cavalcanti and his wife Maria Caterina De Medici, DeCavalcante was nicknamed "The Count".[2] New Jersey mob boss
After the retirement of family boss Nicholas Delmore (real name Nicholas Amoruso)[3] between 1960 and 1964, DeCavalcante replaced him. Shortly after that, he acted as a liaison between the Mafia Commission and the Bonanno crime family after the beginning of the Bonanno War between the New York Five Families. Under DeCavalcante's leadership, the New Jersey Mafia was transformed from a dysfunctional group of ever-warring factions into a cohesive and profitable crime family. He also doubled the number of "made men" in the family.[4] DeCavalcante altered longstanding parts of the Mafia initiation ritual, abolishing the use of a gun, a knife and a burning holy card when "making" new members of his organization as "he did not feel it was necessary", according to Vincent "Vinny Ocean" Palermo.[5] Despite this, he insisted there was no difference between the New Jersey Mafia and the Five Families on the other side of the Hudson River and declared: "Cosa Nostra is Cosa Nostra. An Amico Nostro is an Amico Nostro".[4] DeCavalcante oversaw illegal gambling, loansharking, and labor racketeering in New Jersey. He also had interests in lucrative pornography businesses in two states.[6] Living in the Lawrenceville section of Lawrence Township, but working in Newark, DeCavalcante commanded an organization of around 60 "made" members active in the tri-state area of New Jersey, New York and Connecticut.[7] The DeCavalcante crime family, as it came to be known, operated primarily in New Jersey, with interests in Connecticut, Troy, New York, and suburbs of New York City.[8]
DeCavalcante's legal business front was the Kenilworth Plumbing and Heating Co., a plumbing supply store in Kenilworth.[9] He and his wife Mary had three sons, Frank,[10] Robert, and Carl.[7] He later resided at 1015 Mercer Street in Princeton.[11] DeCavalcante's ownership of a plumbing supplies store earned him the nickname "Sam the Plumber", although his preferred sobriquet was "The Count", which derived from his claims that he was the son of an Italian marquis. Another nickname of his was "the Claw", as he had a reputation as a usurious loan shark.[4]
From 1961 to 1965, DeCavalcante was the subject of a Federal Bureau of Investigation (FBI) investigation known as the "Goodfella Tapes" or the "DeCavalcante Papers". The FBI used wiretaps and bugs at four locations in New Jersey and Pennsylvania, including the office of DeCavalcante's Kenilworth plumbing supply firm, to record conversations among DeCavalcante and his associates which revealed detailed information on the day‐to‐day operations of the Mafia and crimes including labor racketeering, corruption, loansharking and murder.[12][13] The other locations where electronic surveillance was utilized were the Best Sales Co., a company in Newark controlled by Gerardo Catena, the Penn Jersey Vending Co. in Philadelphia, owned by Angelo Bruno, and a building known as "the Barn", located at the rear of a restaurant on U.S. Route 22 in Mountainside.[14] The investigation confirmed claims by cooperating witness Joe Valachi, provided crucial information on La Cosa Nostra, and revealed the existence of the Mafia Commission.[9] One Justice Department official described the "DeCavalcante Papers" as a report just as crucial as Valachi's disclosures.[14] During these conversations, DeCavalcante repeatedly referred to himself as the "father" (boss) of his "borgata" (crime family).[15] However, since no court order was issued for the wiretaps, none of the tapes could be used to indict DeCavalcante.[16]
Among the eight murders discussed by DeCavalcante and his associates were the 1951 shooting of Willie Moretti in Cliffside Park, and the 1962 hand grenade killing of Charles "Cadillac Charlie" Cavallaro in Youngstown, Ohio. In one conversation, involving DeCavalcante and three others on February 23, 1963, DeCavalcante agreed with Angelo DeCarlo that the method of Moretti's murder was distasteful.[16] Each of the four men were also critical of the method used to assassinate Cavallaro as his 4-year-old son was also killed in the explosion. It was indicated that the use of hand grenades had since been forbidden by the Mafia.[14] In another conversation in 1964, DeCavalcante and two others discussed methods of body disposal, with a car crusher, a garbage compactor and a device capable of turning a human corpse into a "meatball" being mentioned. In 1965, he forbade the killing of an African-American construction worker who had assaulted the son of a Mafioso with a shovel in a fight because the construction worker was a Black Muslim and DeCavalcante feared a war between the Nation of Islam and the Mafia.[17]
In addition to murder, the tapes revealed political corruption and links between mobsters and New Jersey public officials. Days before Thomas G. Dunn was elected Mayor of Elizabeth, he visited DeCavalcante at his Kenilworth office on October 23, 1964. Dunn said to DeCavalcante: "If you have any way of getting to [two redacted names] tell them to keep their lousy mouths shut... Because this thing could cream me at the last minute. So if you can in some way get to these two guys – tell them to keep this thing out of the papers".[14] DeCavalcante promised Dunn support in his mayoral campaign and asked: "Do you think we could get any city work?", to which Dunn laughed and replied: "Well, maybe". In a statement issued on June 10, 1969, Dunn claimed that at no point during the meeting had DeCavalcante asked him "to do anything irregular or illegal", and that he had had no contact with DeCavalcante since.[14] He also denied that DeCavalcante had any influence over his administration and claimed that he had not been aware of DeCavalcante's underworld associations.[17] Other public officials implicated by the tapes included Cornelius Gallagher, a member of the U.S. House of Representatives. In January 1965, DeCavalcante, along with Joseph "Bayonne Joe" Zicarelli, met with Emanuel Riggi, a reputed mafioso who the government was seeking to deport. At the meeting, Zicarelli suggested that Riggi contact Congressman Gallagher, who "if the case ever got to Washington, would be in a position to get [Riggi] a favorable ruling".[14] Gallagher had allegedly been connected with the Mafia since at least 1960.[18] He denied that he was involved in Riggi's case and said: "Many kinds of people drop names of public figures. But no one is responsible for people dropping his name, whether the name droppers be reputable or disreputable individuals".[14] DeCavalcante also discussed police
